In the 1970s , Congress moved to create a consumer protection mechanism to prevent unscrupulous persons from absconding with funds from single-seat ticket sales. It was folded into Title 14 of the Code of Federal Regulations, as Part 380, and administered not by the FAA, but directly by the DOT. With little exception, the law has remained untouched since it was enacted. Part 380 has been successfully used around the nation to make previously inaccessible air travel available to the common flier. Put simply, Part 380 is a legal mechanism allowing for individual seats to be marketed and sold in a Part 135 operating environment without commuter authority.

There are a little less than 200 Indirect Air Carriers approved by the US DOT. In 2009, 13,267 public charter flights were filed with the DOT.
